Public Index walkthrough

How to use the Charleston County Public Index correctly

The Public Index is the primary official online place to identify many Charleston County Circuit and Family Court records. It can show case details, parties, actions, judgments, financials, rosters, and document access where available. The online system also warns that its information is not the official record.

Open the official Public Index.

Use the Charleston County Public Index linked from Charleston County and the South Carolina Judicial Branch. Read and accept the disclaimer before searching.

Choose the correct court type and agency.

Use Common Pleas for civil Circuit Court matters, General Sessions for criminal Circuit Court matters, and Family Court for public family-case information where available.

Search by full case number when known.

A full case number is more precise than a name search. South Carolina case numbers often encode year, case type, county number, and sequence; do not remove leading zeros unless the portal supports it.

Use name search carefully.

If searching by party name, compare the case number, court agency, party role, filing date, action history, roster, judgment, and financials before assuming a match is the person or business you mean.

Open the case details and actions screen.

For Common Pleas cases, the Clerk’s redirect note says document viewing uses the documents icon on the case details actions screen when images are available.

Use the Clerk for official copies.

For certified records, use the Clerk’s copy process. A Public Index printout is not the same as a certified copy with a raised seal.

Public Index privacy update: the Charleston County Public Index disclaimer states that, as of January 1, 2026, home address information will no longer be displayed on the public index for both new and existing cases. The disclaimer also prohibits data scraping and explains how a person can request redaction of listed personal identifiers from an online official-record image.
Copies and fees

How to request Charleston County court record copies and certified records

The Clerk FAQ says documents and exhibits filed in General Sessions, Common Pleas, and Family Court are generally available for viewing by request in person during normal business hours, unless the record is sealed, confidential, or legally restricted. Copies may be requested in person or by mail.

Requests should include a specific case number and the names of the parties involved. Certified copies require a certification fee. The Clerk directs payment by cashier’s check or money order payable to Charleston County Clerk of Court for mailed record requests.

Magistrate and traffic

Charleston County Magistrate, Summary Court, traffic, and online payment notes

Charleston County Magistrates/Summary Courts handle many criminal, traffic, landlord-tenant, small civil, bond, and preliminary hearing matters. The county explains that Magistrates have civil jurisdiction when the amount in controversy does not exceed $7,500 and criminal trial jurisdiction for many offenses punishable by a fine not exceeding $500 or imprisonment not exceeding 30 days, although specific exceptions can apply.

Magistrate records may involve
  • Traffic tickets and lower-level criminal charges.
  • Bond hearings and preliminary hearings.
  • Landlord-tenant actions.
  • Small civil claims within magistrate jurisdiction.
  • Restraining orders involving non-family members.
Traffic payment warnings
  • No partial payments are accepted online through the county online payment page.
  • Some charges still require mandatory court appearance.
  • Online payments must be made at least 48 hours before scheduled court date and time.
  • A $1.00 portal fee and 1.7% convenience fee are listed for online payments.
Do not confuse payment with disposition: paying a ticket or charge online may not remove a mandatory appearance and does not automatically explain all license, warrant, bond, insurance, or criminal-history consequences. Review the charging document and contact the specific court when unsure.
Probate and marriage

Charleston County Probate Court records are separate from Circuit and Family Court records

Probate Court handles marriage licenses, estates of deceased persons, guardianships and conservatorships, minor and wrongful death settlements, and involuntary commitments involving mental illness or chemical dependency. These records are not ordinary Common Pleas, General Sessions, or Magistrate case records.

Access limits

Charleston County access limits, sealed files, redactions, and missing documents

Not every court record is available online. The Clerk FAQ states that some documents or cases are not available for public viewing because they are sealed by court order or confidential by the nature of the action. It specifically identifies juvenile files, abuse and neglect files, and grand jury materials as confidential, and adoption and termination of parental rights files as sealed and accessible only by court order.

Records that may be restricted
  • Juvenile files.
  • Abuse and neglect files.
  • Grand Jury materials.
  • Adoption files.
  • Termination of parental rights files.
  • Sealed, confidential, or court-order-protected documents.
What to do when a record is missing online
  • Confirm the court type and court agency.
  • Use case number rather than broad name search if available.
  • Check whether the record predates online coverage.
  • Ask the Clerk whether the file is paper, archived, sealed, or confidential.
  • Use Probate, Magistrate, appellate, jail, or federal systems if the record belongs there.
Redaction reminder: the Public Index disclaimer explains that certain personal identifiers, such as Social Security, driver’s license, state identification, passport, bank account, credit card, debit card, PIN, or password information, can be requested for removal from online official-record images when the required written request identifies the page containing the information.
Court vs jail

Charleston County court records are not the same as jail, sheriff, police, or vital records

A court docket shows court activity. A jail record shows custody. A police report comes from the investigating law-enforcement agency. A marriage license comes from Probate Court. A divorce decree comes from Family Court. A federal docket comes from PACER.

Do not confuse Charleston County record systems

Troubleshooting

What to do if a Charleston County court-record search returns no result

Check search mistakes
  • Wrong court agency: Common Pleas, General Sessions, Family, Probate, Magistrate, Master-in-Equity, appellate, or federal.
  • Wrong spelling, business suffix, maiden name, middle name, alias, or date range.
  • Searching by name when the case number is available.
  • Using a traffic payment search for a Circuit Court case.
  • Searching a federal or bankruptcy case in the county Public Index.
  • Searching a Probate estate record in Common Pleas.
Check access and age limits
  • Common Pleas record before 1989.
  • General Sessions or Family Court record before 1992.
  • Common Pleas image before 1999.
  • Sealed, confidential, juvenile, abuse and neglect, adoption, TPR, or grand jury record.
  • Older paper, archive, or courthouse-only file.
  • Public Index delay, roster change, or data-entry timing issue.
Best next step: contact the responsible office with the court type, case number if known, full party names, filing year, document title, and whether you need certification. Ask whether the file is online, in paper form, archived, sealed, confidential, at another office, or in a federal system.
Docket help

How to read Charleston County case information without over-interpreting it

A Public Index case page can contain parties, actions, judgments, financials, associated cases, rosters, attorney names, court agency, filing date, status, and disposition fields. These are useful, but they do not always explain the complete legal meaning of the case.

Party roles

Plaintiff, defendant, petitioner, respondent, solicitor, public defender, officer, bond entity, attorney, decedent, personal representative, guardian, and ward are roles. A role alone does not prove wrongdoing.

Common actions

Complaint, indictment, warrant, affidavit, motion, order, filing, bond hearing, preliminary hearing, plea, sentence, judgment, dismissal, continuance, and satisfaction should be read with later entries.

Financials and judgments

Fine, costs, balance due, judgment, lien, payment, satisfaction, and post-judgment entries may change. Verify current balances or satisfaction with the court or Clerk.

Filing is not proof: a complaint, indictment, citation, warrant reference, charge, petition, or motion is not proof that an allegation is true. Verify final court disposition before making decisions or publishing claims.
Legal and privacy safety

Use Charleston County court records carefully

Identity-matching rules
  • Do not identify someone from a common name alone.
  • Compare county, court agency, case number, filing date, party role, attorney, action history, and lawful identifiers.
  • Do not assume an arrest, charge, indictment, citation, complaint, or petition is true.
  • Do not assume a civil judgment reflects current payment or satisfaction status.
Responsible publishing rules
  • Do not harass, threaten, shame, or retaliate against anyone.
  • Do not republish children’s names, protected addresses, financial identifiers, medical details, victim information, or unnecessary personal data.
  • Do not bypass sealed, confidential, juvenile, abuse and neglect, adoption, TPR, grand jury, or restricted-record protections.
  • Contact the official custodian for corrections, redactions, sealing, expungement, and certified-copy needs.
