Why the filing county matters for WV magistrate court records

The statewide magistrate search helps you identify the case and the county, but copies are handled locally. The West Virginia Judiciary instructs users to call or visit the magistrate court clerk in the county where the case is filed to obtain copies of specific magistrate court records.

County circuit clerk

Use this office for circuit court files, WVPASS issues that need local validation, family court filings, family orders, appeals from magistrate or municipal courts, and certified copies.

County clerk / county commission

Use this route for many probate, estate, land, deed, marriage and county commission records. These are not ordinary magistrate court case records.

The Supreme Court of Appeals supervises the state judiciary, but magistrate and circuit court copies are normally requested from the county clerk office where the case was filed. Use Court Information by County before visiting any courthouse.
Court structure

West Virginia court-type guide for common search needs

Choosing the correct court level is the biggest time-saver. Magistrate records, circuit records, family records, municipal records and appellate records have different access routes.

Magistrate Courts

Magistrate courts are limited-jurisdiction courts. They handle many small claims, misdemeanors, preliminary felony examinations, warrants, bail, costs, fines and emergency protective orders. Circuit courts hear appeals of magistrate court cases.

Circuit Courts

Circuit courts are West Virginia’s general jurisdiction trial courts of record. They handle felonies, major civil cases, equity matters, extraordinary writs, certain misdemeanors and appeals from magistrate and municipal courts.

Family Courts

Family courts handle divorce, annulment, separate maintenance, paternity, grandparent visitation, name change, infant guardianship, child custody and family support proceedings, except child abuse and neglect proceedings.

Municipal Courts

Municipal courts handle city ordinance and local ticket matters created by municipalities. Appeals may route to circuit court, but the original city case may remain with the municipal court.

Appellate Courts

Federal Courts

Federal civil, criminal and bankruptcy cases are searched through PACER and federal district or bankruptcy courts, not through WV magistrate search or WVPASS.

How to avoid false matches when searching WV court records by name

Name searching is useful, but West Virginia has 55 counties, multiple court levels and many people with similar names. Treat name search as a lead, not proof.

Request copies

How to request West Virginia court record copies

The best copy request is specific. Ask for the exact magistrate judgment, complaint, civil order, criminal disposition, circuit order, family court order, appellate brief, mandate, docket sheet or other document you need.

Find the case number and filing county.

Use MCRSearch for magistrate cases and WVPASS for circuit records. Case number and county are the two most useful details for a clerk.

Identify the correct custodian.

Use the magistrate clerk for magistrate records, the circuit clerk for circuit and family-file records, the appellate clerk for appellate filings and PACER for federal documents.

Name the exact document.

Examples include final judgment, dismissal, sentencing order, warrant return, complaint, docket sheet, family order, appeal order, mandate or certified disposition.

Ask whether a plain, certified or authenticated copy is required.

A screenshot or search-result printout is not the same as an official certified court copy.

Ask about confidentiality first.

Family court file contents, juvenile records, sealed records, domestic violence records involving minors and certain protected information may require authorization or court order.

Confirm cost and delivery method.

Ask the clerk for the current fee, postage, payment method, processing time and whether the record can be emailed, mailed, picked up or inspected in person.

Why a West Virginia court record may not appear online

“Not found online” does not always mean no record exists. The case may be in the wrong court level, wrong county, municipal court, family court, probate route, state appellate court, federal court or criminal-history system. It may also be sealed, juvenile, expunged, confidential, too new, archived, under another name or unavailable through public remote access.

Access or custody issues
  • Magistrate documents are not provided online through MCRSearch.
  • Sealed filings and juvenile cases are not available through WVPASS.
  • Family court file contents are generally confidential.
  • Juvenile proceedings and child abuse/neglect records have public-access limits.
  • Domestic violence records involving a minor child may be confidential in some circumstances.
  • Unserved warrant information and sensitive identifiers may be protected.

Payments and tickets

Magistrate court payments, citations and payment-plan IDs

The Magistrate Court Payment System is separate from Magistrate Case Record Search. It is for online credit card payments for costs, fines and fees related to magistrate court criminal matters. The system requires a Case ID number, Citation ID number or Payment Plan ID number.

Use the payment system only with an ID

If you do not have a Case ID, Citation ID or Payment Plan ID, the payment system instructs you to contact the Magistrate Court Clerk’s Office in the county where the case was filed.

Read payment consequences

Paying a citation, cost or fine may affect case status, obligations, deadlines or rights. Contact the clerk or attorney if you are unsure what a payment means.

WV.gov payment cost

The payment system states that the WV.gov price includes $2 per payment. Review the checkout total before submitting card information.

Case search versus payment

Use MCRSearch to locate case information. Use the payment system to pay eligible costs, fines or fees when you already have the required ID.

Municipal tickets may differ

A city ordinance or municipal court ticket may be handled by a municipal court, not the magistrate payment system. Read the citation carefully.

Validate with the clerk

Family and juvenile

Family court, juvenile and domestic violence record access is different

Do not treat family court, juvenile and domestic violence records like ordinary magistrate civil case results. West Virginia rules place special limits on these records.

Family court orders and indices

Family court rules state that all orders and indices are public records, but the file contents are treated differently.

Family court file contents

Pleadings, recordings, exhibits, transcripts and other family court file documents are confidential and generally available only to authorized people.

Family proceedings

Family court proceedings are not open to the public. Do not assume a family hearing can be recorded, photographed or shared.

Juvenile records

Juvenile records are not ordinary public records. Access may be limited to authorized agencies, parties, attorneys or people with a court order.

Domestic violence records

Ask the circuit clerk

Family court filings are generally filed with the circuit clerk. Ask the circuit clerk what can be inspected, copied or certified under current rules.

Plaintiff / Petitioner

Appeals and federal

West Virginia appeals, federal court records and bankruptcy records

Appeals and federal cases are separate from ordinary WV magistrate court record searches. If a magistrate court case was appealed, the circuit court record may be important. If a circuit court case was appealed, use the appropriate West Virginia appellate court resources.
